By accessing or using Score My Surf ("the Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
By uploading video content, you explicitly accept these Terms and our Privacy Policy, including our data collection and research purposes.
We maintain logs of your acceptance, including timestamps, for legal compliance purposes.
2. About Score My Surf
Score My Surf is an AI-powered surfing analysis platform operated by [Your Legal Entity Name], registered in England and Wales [Company Number]. We provide automated wave scoring using computer vision and machine learning technologies.
Service Features:
- Anonymous Users: Upload videos and receive AI-generated wave scores
- Registered Users: Access to wave history and personal dashboard
- Leaderboard (Opt-in): Share your best waves publicly and compare with other surfers
- Ongoing Development: Features and models are continuously improved through research
3. User Accounts
3.1 Registration
Creating an account is optional but required for accessing wave history and leaderboard features. You must provide accurate information and maintain the security of your account credentials.
3.2 Anonymous Use
You may use the wave scoring feature without creating an account. Anonymous uploads are still subject to these Terms, including our data collection and research provisions.
3.3 Account Responsibilities
You are responsible for all activity under your account. Notify us immediately of any unauthorised access.
4. Video Uploads and User Content
4.1 Your Representations and Warranties
By uploading video content to Score My Surf, you represent and warrant that:
- You own the video or have obtained all necessary rights, licenses, consents, and permissions to upload and share it.
- If the video contains identifiable individuals (including surfers, bystanders, or others), you have obtained their consent to record, upload, and share the footage
- The video does not infringe any third-party rights, including copyright, privacy, or intellectual property rights.
- The video was not downloaded from YouTube or other platforms unless it was your original content or uses a Creative Commons Attribution license.
- The content complies with all applicable laws and these Terms.
4.2 License Grant to Score My Surf
By uploading video content, you grant Score My Surf a worldwide, non-exclusive, royalty-free, transferable license to:
- Process, analyse, and store your video.
- Extract pose estimation data and other technical features.
- Display your video on leaderboards (if you opt-in)
- Use your video and extracted data for AI model training, development, and improvement.
- Use your video for academic research in action recognition and sports biomechanics.
- Create derivative works (including anonymised datasets) for research purposes.
You retain ownership of your original video content.
4.3 Prohibited Content
You may not upload videos containing:
- Illegal activities or content
- Nudity, sexual content, or inappropriate material
- Harassment, hate speech, or violence
- Content that infringes third-party rights
- Malicious code or harmful files
- Deliberately poor quality content intended to corrupt our models.
We reserve the right to remove any content that violates these Terms.
5. Data Collection and Use
5.1 What We Collect
When you use Score My Surf, we collect:
- Video files: Your uploaded surfing footage
- Pose estimation data: Skeletal keypoint coordinates extracted from videos.
- Scoring data: AI-generated wave scores and manoeuvre classifications
- Account information: Email, username, and profile data (registered users only)
- Usage data: Upload timestamps, IP addresses, and platform interactions
- Technical data: Device information and browser metadata
5.2 Dual Purpose Processing
We process your data for two distinct purposes:
A. Service Provision (Contract Performance)
To deliver Score My Surf features:
- Generate AI wave scores.
- Maintain your wave history.
- Display videos on leaderboards
- Provide platform functionality
Legal Basis: Performance of contract (GDPR Article 6(1)(b))
B. AI Research and Development (Consent + Legitimate Interest)
To advance surfing action recognition technology:
- Train and improve machine learning models.
- Test new pose estimation approaches.
- Conduct manual annotation and quality verification.
- Reprocess videos with updated algorithms.
- Publish academic research in sports biomechanics.
Legal Basis: Your explicit consent (GDPR Article 6(1)(a)) + Legitimate interest in scientific research (GDPR Article 6(1)(f))
By uploading content, you consent to both purposes.
5.3 Data Retention
- Videos:
- Registered users: Retained as long as you keep them on your account or leaderboard, OR up to 10 years for research purposes (whichever is longer)
- Anonymous users: Retained for up to 10 years for AI model development and research
- Pose estimation data: Retained indefinitely in anonymised form for model training.
- Account data: Retained while your account is active, plus 12 months after account closure
Justification: Extended video retention is necessary to support model retraining with improved techniques, manual annotation for dataset quality, and longitudinal research in action recognition.
5.4 Anonymisation and Pseudonymization
We implement privacy-enhancing measures, including:
- Face blurring (pseudonymization) where technically feasible
- Metadata removal from pose datasets
- Aggregation of training data to prevent individual identification
However, videos containing identifiable individuals constitute personal data under the GDPR, even with these measures in place. Movement patterns (gait) may constitute biometric data.
5.5 Data Sharing
We do not sell your personal data. We may share data with:
- Service providers: Cloud storage, hosting, and infrastructure partners under data processing agreements
- Research collaborators: Academic institutions, under appropriate data sharing agreements and with additional anonymisation
- Legal requirements: When required by law or to protect our rights
5.6 International Transfers
Your data may be transferred to and stored in countries outside the UK/EEA. We ensure appropriate safeguards are in place, including Standard Contractual Clauses.
6. Your Rights Under GDPR
As a UK/EEA data subject, you have the right to:
- Access: Request a copy of your personal data
- Rectification: Correct inaccurate data
- Erasure: Request deletion (see Section 7)
- Restriction: Limit how we process your data
- Portability: Receive your data in a structured format

7. Deletion and Data Retention Rights
7.1 Registered Users
You can delete individual waves from your account settings at any time. Deletion options:
- Remove from Leaderboard: Hides from public view but retains for research (pseudonymized)
- Complete Deletion: Permanently removes video from all systems, including research datasets
Complete deletions are processed within 30 days to allow for backup system compliance.
7.2 Anonymous Users
To request deletion of anonymously uploaded content, email [email protected] with:
- Upload date and approximate time
- Video description or identifying details
- IP address or location (if known)
We will make reasonable efforts to locate and delete your content within 30 days.
7.3 Limitations on Deletion
We may retain data when:
- Required by legal obligations
- Necessary for legal claims or compliance investigations
- Data has been irreversibly anonymised and incorporated into aggregate datasets.
8. Leaderboard and Social Features
8.1 Opt-In Requirement
Sharing waves to the public leaderboard requires explicit opt-in. Leaderboard content is publicly visible to all platform users and visitors.
8.2 Public Display
By sharing on the leaderboard, you consent to:
- Public display of your video and score
- Your username or display name is being shown.
- Other users are viewing and comparing your waves.
8.3 Removal
You can remove your waves from the leaderboard at any time through your account settings.
9. AI Accuracy and Limitations
9.1 No Professional Endorsement
AI-generated scores are informational estimates based on machine learning models. They should not be treated as:
- Official judging outcomes
- Professional coaching feedback
- Definitive assessments of surfing ability
9.2 Model Limitations
Scoring accuracy may vary based on:
- Video quality and recording angle
- Weather and water conditions
- Pose estimation reliability
- Model training data coverage
9.3 Continuous Improvement
Our models are continuously updated. Scores for the same wave may change as models improve. Historical scores are not retroactively recalculated unless you explicitly reprocess.
10. Intellectual Property
10.1 Platform Ownership
Score My Surf, including all code, models, designs, and algorithms, is owned by [Your Legal Entity] and protected by copyright and intellectual property laws.
10.2 User Content Ownership
You retain ownership of the videos you upload. The license you grant us (Section 4.2) does not transfer ownership.
10.3 Restrictions
You may not:
- Copy, modify, or reverse engineer the Platform.
- Extract or scrape leaderboard data systematically.
- Use our models or algorithms outside the Platform.
- Remove copyright notices or branding.
11. Prohibited Uses
You agree not to:
- Upload content you don't have the right to share
- Violate any laws or third-party rights.
- Upload malicious code or attempt to compromise security.
- Harass or impersonate other users.
- Use automated tools to access the Platform (except with permission)
- Manipulate scores or engage in fraudulent activity.
- Download others' videos from the leaderboard without permission.
12. Service Availability
12.1 No Guarantee of Uptime
The Platform is provided "as is". We do not guarantee:
- Continuous, uninterrupted access
- Error-free operation
- Specific processing times
- Permanent availability of features
12.2 Maintenance and Updates
We may temporarily suspend service for:
- Maintenance and updates
- Model retraining and deployment
- Security measures
- Infrastructure changes
12.3 Beta Status
Score My Surf is currently in beta. Features may change, be added, or removed without notice.
13. Limitation of Liability
13.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR LEGAL ENTITY] SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or use
- Damage to reputation
- Third-party claims arising from your content
OUR TOTAL LIABILITY SHALL NOT EXCEED £100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER).
13.3 Indemnification
You agree to indemnify and hold harmless Score My Surf from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your uploaded content
- Your violation of third-party rights
- Your use of the Platform
14. Changes to Terms
We may update these Terms at any time. Changes will be effective:
- Immediately for new users upon first use
- 30 days after notice for existing users
Continued use after changes constitutes acceptance. We will notify registered users of material changes via email.
15. Account Termination
15.1 By You
You may delete your account at any time through account settings. Account deletion does not automatically delete videos retained for research purposes (see Section 7).
15.2 By Us
We may suspend or terminate accounts that:
- Violate these Terms
- Upload prohibited content
- Engage in fraudulent activity.
- Remain inactive for 3+ years.
Upon termination, your access ends immediately, but data retention is governed by Section 5.3.
16. Dispute Resolution and Governing Law
16.1 Governing Law
These Terms are governed by the laws of England and Wales.
16.2 Jurisdiction
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16.3 Informal Resolution
Before initiating legal proceedings, please contact us to attempt an informal resolution.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Score My Surf.
